What is a scaffolding accident?
Simply put, a scaffolding accident is any accidental injury caused by scaffolding. While people often link scaffolding accidents to of a fall from height, it can actually cover any accident involving a raised platform.
These accidents don’t just impact workers on the structures, but passers-by harmed because of the scaffolding. The structure could be faulty, workers may be improperly trained, or required the safety measures may not be in place.
It's true that most scaffold accidents do happen on building sites, but you can still claim if yours happened elsewhere, so don't feel put off if your story is slightly unusual.
What are the causes of scaffolding accidents?
Your employer has a legal duty to put your safety first but, of course, accidents still happen. The National Access and Scaffolding Confederation tell me there were 87 scaffolding accidents in the UK in 2023. I've been around for enough dog years now that I've seen it all, but here are the most common causes:
- Faulty or poorly maintained scaffolding: for example, rotten planks or rusty tubes. Claims for injuries suffered as a result of these can be made under the Employer's Liability Defective Equipment Act 1969.
- Obstacles: tools or cables left on walkways can prove a major trip hazard.
- Weather: if you're asked to work in adverse conditions such as high winds, rain or freezing temperatures, you may not be safe and could claim if you get hurt.
- Poorly laid flooring: if planks are raised, uneven or left with gaps, you're at a much higher risk of a scaffolding accident.
- Lack of safety measures: it's your employer's responsibility to make sure things like barriers, lights and warning signs are all used where needed.
- Lack of PPE: personal protective equipment (PPE) like hard hats and harnesses may be a legal requirement, depending on the scale of the scaffolding. If it is not provided and you are injured, you could have grounds for a claim.
- Workplace conditions: building sites and other industrial settings tend to be busy and noisy. I've known scaffolding accidents occur due to overcrowding and a lack of training on how to communicate.
What are some common types of scaffolding accident?
- Slips, trips and falls on the same level: accidents in this overall category made up nearly a third of all non-fatal workplace injuries in Great Britain in 2023.
- Falls from height: these can cause fatalities and major injuries. They often happen due to missing handrails, obstacles or uneven flooring.
- Scaffolding collapse: perhaps due to faulty scaffolding or overloading. These accidents have the potential to harm anyone in the vicinity.
- Impact from falling objects: for example, tools falling from the scaffolding to the ground. These can also lead to serious injuries and can impact passing pedestrians as well as workers.
What injuries can be caused by scaffolding accidents?

How do I know who was at fault for my accident?
The first thing to remember is that your employer is legally required to protect you under the Health and Safety Work Act 1974. If they fail in that duty – for example, by asking you to work in unsafe weather conditions – then you can make a claim.

Can I get sacked for claiming against my employer?
No! Just like me, the law is well and truly on your side here, under the Employment Rights Act 1996 and the Equality Act 2010. I know that it can feel uncomfortable to make a claim against those who pay your wages but, if their mistake or negligence caused your scaffolding injury, you have the right to do so. You cannot be sacked or treated differently for seeking compensation, so don't let that stop you.
Why should I make a scaffolding injury claim?
The physical pain from an injury is hard enough to deal with but when it starts to impact your finances too, well, that's really ruff. Although every piece of literature / advertising / information you see states that you have 3 years to make a claim for compensation after an accident that was not your fault - my claim was reject because I had waited 2 years, 6 months and 1 week to raise it. The solicitor I was referred to told me nobody would take me on with less than 6 months to the cut off (I missed this by 1 week) yet the first person I rang after your rejection has taken up the claim - very disappointing and a pure waste of time

Was contacted by National Accident Helpline with regards to a dental negligence query. Was advised during the call that "there was a chance" my claim would not qualify for "no win no fee" as I am in Scotland. After 27 minutes on the call was put through to a Scottish legal firm who advised that "no win no fee does not exist for such claims in Scotland" so I would need to pay between £500 and £1,500 of fees, which would not be refundable. Total waste of my time as I cannot afford this. I should have been advised "no win no fee is not applicable in Scotland for this type of claim". Amateurs.

Although underdog took on my case they forwarded me onto colemans ctts solicitors!!! Do not use them they are useless! Absolute rip off! Going with a reputable company on tv advert you'd think you would get what's rightfully yours. Initially satisfied, representative Solicitor's firm identified and allocated within initial telephone conversation, but when pointed out that there was a conflict of interest with said firm, encountered numerous issues. These included said firm still contacting me to have to be told of the conflict, impatient call handler (Anthony), was poor and may have used a profanity, which I suspect wasn't meant for me to overhear. Eventually spoke with a Manager, (John), who advised that the firm offered was the only suitable one available to them, based on circumstances as outlined. I'm all 3 days wasted in respect of my claim!

Put me in touch with a firm of solicitors who said due to time limitations they could not help. Rang National Accident a Helpline back who said they were only allowed to refer me to one Solicitor but there may be others out there who could help? Complete waste of my time as I did double check at the outset if this was something they could help with.

After my initial, pleasant chat with Nick and having requested that I had a call from you between 2 and 3p.m. - thus allowing me to take my medication and have a rest - I was angry to receive a phone call from your Solicitor (whose name I could not catch even after listening x 3 times) at 12.20p.m.. I spoke to a lovely gentleman who took all my details regarding a fall I had outside some public toilets and really hurt my back. I was still suffering after a month and had been to the doctors three times taking really strong pain killers (tramadol) I spent 30 mins on the phone explaining what I had done and was told I would be transferred to a firm of solicitors. I was put through and spoke to a lady who took more details and someone would come out to see me. Today I receive an email from the Solicitors saying they would not take my case any further, I am disgusted and would not bother again trying to get compensation through any claims company.

Absolutely horrific. Very quick to want to take you on board as a "customer" promising the world, returning calls and acting promptly but the instant you are handed over to their representatives Minster Law it all went downhill from there. I was a passenger in a car accident where we were struck from behind on a motorway. They have dragged the process out over the last nine months, never listen to what you tell them and have no urgency or interest whatsoever and it was always a case of me having to be the one chasing them and often ignored for weeks on end. Treat terribly by their "specialist" and even though the other party openly admitted fault and the car I was in was written off, it's taken them 9 months to submit the claim and report only to tell me that the other side haven't made an offer therefore they will not proceed further because there is no engineers report for the car that was written off and will not litigate. So despite the fact the other party admitted fault, the fact I've been to the doctors, hospital and physio on countless occasions with reports from multiple assessments with different doctors/physics, not to mention their ridiculous "specialist" plus I also allowed them access to my personal health history and they're now fobbing me off, completely useless and a waste of time. Save yourself the aggro and use somebody else. I feel like I've been scammed and for all I know they could have claimed and pocketed the claim payout. Pathetic. Never again and would not recommend them to a soul, sorry guys. Steer clear.

I made my claim last year at first I needed to fill out lots of paperwork which I did. The last time I heard from K H Lawyers was October/November time and haven't heard a word since.
