Usually, you need to have started court proceedings or settled your claim within three years. The clock starts ticking from the date of injury, or from when you knew the accident was the cause.

It's possible to make a claim on behalf of a loved one in certain circumstances.

  • You can also claim compensation for someone who lacks mental capacity, this could be due to their injuries, and is assessed on a case-by-case basis. However, if they regain mental capacity, even briefly, then the usual three-year time limit will apply from the date they regained capacity.
  • You can make a claim for the tragic loss of life caused by a factory accident. This is called a fatal accident claim. In these cases, you have three years from the date of their death, or the date it would have been clear that their factory accident was the cause, to start court proceedings.
